What is the statute of limitations to file a small claims in the state of Iowa
The limitations period depends upon the type of claim at issue.
I helped my niece out several times with fuel, a used car, car repairs while she was having difficulties with her marriage. She told me she would pay me back with her tax returns. Well, when I asked her for it she text ed me and 1st said you have no proof, then another time she said that i should take it from her inheritance. Well, she has no inheritance. I did pay for my sister's attorney fees for her to gain custody, and guardianship of her 1st four children. (A mess in itself and she married a man that was charged with CSC of a 14 yr old.) So, then she said I should stop paying for my sister's attorney fees and I would have money. I never gave her cash, I had her fuel tank filled with my credit card, and wired the money to her ex step father whom bought the car for her with her.
From what I can see the statute of limitations for breach of an oral contract is four years; for a written contract it's five years.
