    Default Avoiding Jail for Back Child Support

    My boyfriend is being held on a 10000 bond for not appearing in court for the charge of non-support of over 5000. We live in Missouri and I've been hearing alot about the new child support laws for back child support. One new bill that just passed last month, is helping fathers who owe back child get back on track by establishing a program through the court system to help them find a job to pay the back child support without having to go to jail. If they're sitting in jail, they just get farther behind. My question: is there such a program in Missouri? And if there isn't what can he expect to get if he's sentenced? I'm trying to help him out and get as much information as I can. He's going stir crazy sitting in jail. He has not had a court date yet and he hasn't been assigned a public defender.

    Why wasn't he paying his support?

    First, your BF made a huge mistake not appearing in court. from now on, he'll need to keep in touch with the CSE agency and always appear for hearings, especially for non support hearings.

    I don't know if MO has the type of program you are asking about. The best thing will be for your BF to simply ask the court about it when he goes to court. Being in jail already, he might not be able to get in contact with the CSE caseworker, but that is who he really needs to speak to about how to get things started for paying both arrears and current support.

    ETA: I just read your other threads. Your BF is being charged with felony noin support, that is a criminal charge rather than a civil contempt charge. That changes everything. When your BF does go to court he will likely be given a public defender, he should speak to the attorney about what he can do, I think at this stage he won't be able to speak to the CSE caseworker because it is a felony charge.

    You mentioned that you and him are having a child together soon, you'll need to start preparing now for the likelyhood of having to support your child pretty much on your own since he owes alot of CS to his first child(ren) and also has to appear in court for tickets in another county.

    Back in November of 2008, he got drunk, wrecked our car and lost his license. After he had the wreck his employer let him go. His boss was really big on not drinking. And since then he had a grass cutting job with a guy here in town but he was paid with a personal check and no child support was taken out. Then he lost that job. He's had alot of problems with alcohol. We live in a small rural town and there's mostly seasonal jobs or no jobs at all. Most of the jobs around this area he would have to drive at least 10-30 miles one way to get there and it's really hard when he don't have a license.

    Please don't take this advice lightly. It will make a huge difference in your boyfriend's case and in his life. He needs to quit drinking. He needs Alcoholics Anonymous. This is the perfect time, if he's in jail. Most prisons and jails hold meetings right there. When he gets out he can find more meetings in the community. They are everywhere. If he gets some sobriety under his belt, (90 days is a good start), gets it "recorded" through the leaders of the meetings, (they sign papers at the meetings to attest to his presence there) and then goes to the judge, this will most likely help his case, will give him more time to pay up, and, when he gets out, will help him find a real job. His life is unmanageable now, and anything you do, or he does, will have no good result unless he is sober first. I promise you that. And, if I were you, I'd tell him that if he doesn't get and stay sober, you are out of his life. Don't let it be an empty threat. This guy's drinking is causing him huge problems and now they are spilling over to you. It will only get worse if he doesn't get and stay sober.
