    Default Complications After Surgery

    My question involves medical malpractice in the state of: ohio

    please help everyone keeps telling me i need to file a malpractice suit but not sure what to do. this maybe a little lenghty but i will try to keep to the facts.

    hubby went in a few months ago and had total hip replacement surgeon said surgery went great but when they took him to his room he was very confused and dazed and just was not himself the family associated this with the pain meds and the anthestic (had spinal) the next day is confusion grew more and had no urinary output he complained of chest pain and shortness of breath the nurses would not tell who the dr. was that he was assigned to and kept insting this was from dehydration and they gave him haladol to quiet the aggitation. 2 more days went by became more aggitated more confused and no urinary output finally one doctor came in and said he had kidney failure and if its no better in the next few days would need dyalisis but still insisted nothing was really wrong except some dehydration the next day he coded and went to icu where the dr. came in and said they coded him so he could rest however the test showed he had a heart attack (permanent damage done) from the fluid building up for the past 4 days. all preop testing was done and complete surgical clearance was given including cardiac testing.also he is diabetic and has had previous reactions against insulin injections (is on oral meds and well controlled) it is in his preop testing results he is not to recieve these injections and a allergy band was put on however they still gave the injections to him without my knowledge (until i caught them) and his sugar levels was very out of control because of the injections.

    when he came out of the icu he also has severe foot drop that may or may not ever come back.he lost about about 20 percent brain function including memory ( he dont know his own kids) he has had 14 wks so far of physical and occupational therapy along with speech therapy. when he went for follow up appointment with surgeon his only remarks was the hip is fine and that i should not be so upset that he is alive and get over it already. is their anyone with any suggestions on whether or not i should file suit or do what the surgeon said just get over it.

    Make sure you get his complete medical records-every single piece of paper-every doctor's notation, etc. Let a medical malpractice attorney or someone qualified review such records that has experience and works for an attorney such as a Para Legal examine it and see if you have a case with merit worth persuing. If so, file immediately as memories fade after a time. The quicker you do this the better. Also make notes of things that do not look right in the record-omissions or otherwise. Hospitals and doctors are well known to wait a certain period of time-say 45 days to allow the complete record to be released (allegedly to make sure everything is documented accurately and signed off after doing so) where many times they can make the record appear as if they are not negligent and this is no exaggeration. If you have a case go after them. It's Justice that is sought before everything else and then you will have the closure you need. Good luck.

    I got the medical records and justice you are right alot of the medical records are not there including meds list. I have recently seen a lawyer and he is looking over what I was able to get and is sending for more records. looking through the records alot of things that took place was not even noted the hospital dr diagnosed a mi (heart attack) when in fact his heart problems came from the fluid that backed up from his kidneys. As I told the attorney its not the idea of the money its the idea to help someone else that may not have someone to be an advocate for them as my family stuck together during this time there is a lot of people that dont have no one especially older people. I will keep everyone informed as to if there is a suit in my case or not.
