Hi all, I recently got into an altercation where the other individual swore a warrant out to have me summons to court. I am fairly confident in my defense and trial, and will recap that in a second.

I read under Virginia law that self defense can get you out of it, as long as your defense is not more commesurate than the aggressors ( i.e not pulling a gun if they are punching you ).

With that said, I was wondering if my defense of self defense would work on this...

We had people over drinking. My sister feel 16 feet through a ceiling and I rushed to help. I had stopped drinking and trying to sleep for about two hours now, while others still drank.

I got to her, she was out cold and people gathered on the stairs ( this is two flight step, with a landing between them ). I rushed through them to get my dad, in which one person was knocked down. That person began to kick and slap at me while laying down as I was trying to get by in the hallway. My dad had came out the door and grabbed me around the arms, I guess so I didn't start nailing the person. I kicked back at their legs since I was held and could not even move out of the way.

This ended up stopping here. My sister dazed went into her room, and I was explaining to my dad what happened with her. I went to her door, standing out in the hallway still. When I did, the other person came out punching at me, hit me in the shoulder. At which point, the next punch thrown, I caught their arm mid flight, and pulled it back over their head putting them on the ground. I let go and backed off, still trying to check on my sister.

The other people do not live in the house. When cops came, noone was arrested, no markings on anyone else except me where I was repeatedly kicked in the legs and waist, and an old cut was torn open on my shoulder.

Cops almost arrested one of the other persons friends because they were being beligerent, which is the aggressors only witness in this case. I have my father and fiance to speak on being attacked and so forth.

Now, in this case, would all that I did be self defense? I did no other contact or provocation in this matter. My thought was that the person came out from a room to attack me again would clearly show them as the aggressor.

Should I have a warrant sworn out on them and can I now?
