    If you hadn't said California I would have suspected that you were in the area of Florida where I live. Yes, there are corrupt prosecutors and police agencies who will try to convict people on false evidence. It is important to root out such cases or it can make for a miserable community for everyone to live in. Good luck with your case.

    Obviously you are clueless. You already got answers.

    You can NOT sue a DA under ANY circumstances. The DA/SA has ABSOLUTE immunity. Anyone who tells you differently is full of crap.

    You don't have much chance of suing the sheriff or deputies either unless you are really prove your case.

    There is only own way to do anything to the DA and that is at the ballot box.

    I was in a similar situation with a crooked transmission shop who got the SA to arrest me and take me to trial for allegedly stealing a transmission. The jury found me not guilty in 12 minutes and the judge reprimanded the assistant sa that it was a civil case. The owners of the transmission shop lied repeatedly and said different things at different times under oath.

    I sued the owners and they settled for 11k. Mind you, I only went to jail for 3 hours and if you didn't serve any real time, you don't have much in the way of damages. There was no way to sue the SA. Not even the attorney general of the state has any real control over the SA or DA.

    Instead, when he ran for re-election I encouraged an attorney friend of mine to run against him. I had a website about the SA and ran an effective negative campaign against him using flyers and other means. (Helps that I own a printing plant plus a small movie studio.) I pissed him off so bad he wrote a libelous letter to the paper and he did it on state time, which is a criminal offense. He also used NCIC to try to dig up dirt on me which is a federal crime. He was defeated. In his final days he had his top assistants dig into my life to find something he could arrest me for. Conspiracy can be applied to almost any tort in Florida, by the way. He never thought he would lose and I would have full access to the records of the State Attorney's office.

    He and the newspaper is now being sued for a few million and I will probably have him disbarred. Now, that is revenge.
