I own a 4 unit Commercial building in Massachusetts, I use 2 units and rent two as tenants at will. Earlier this year I made the decision to put my building up for sale later this year so I ran a ad for tenants and rented both, tenant one is great, tenant two always has an excuse, he was in business in another state so I thought he would do fine, I have bent over backwards to help this tenant, now I did some searching and found he filed chapter 13 bankruptcy on his house a month and a half ago ( he does not know I know), I thought with tenants this would help me sell my property so my wife and I could move on in our older years, any suggestions would be appeciated as he now owns over 6K in rent. I would like to recover this money, Can I attach his house even though he filed chapter 13 ? Also I should mention that my property needs nothing and meets and exceeds all city requirements.
