My question involves criminal law for the state of: Colorado
My son was charged with third degree assault/domestic violence last Friday. He was arrested and spent the weekend in jail. On Monday, he was given a restraining order (in court) stating that he cannot go home, even though the alleged victim does not live at his house, and the house belongs to me. He is currently staying with me at my primary residence.
The other party was taken to the hospital and is now in rehab. I have had to engage an attorney for eviction even though the person does not live at my property, my son cannot go back there until an eviction is completed. This person fell down the stairs and hit her head on the corner of the stone fireplace and my son called 911 for an ambulance because it was a sizeable gash. We later learned she had a BAC .5 and was lucky to be alive.
However, after reading threads here, it sounds like I will also need to hire an attorney for the assault charge, the pre-trial hearing is in 2 1/2 weeks and from all I've read here, the DA probably may proceed even though the other party won't be appearing... this would be a first time offense for him, and it's already costing me a small fortune, but should I retain counsel?
