    coming out of festival tried different road. was pulled because it appeared that i was trying to cut in line. was then asked if i had been drinking. and then the obious

    all of the traffic was filing out of a parking lot on privite property

    If they pulled you over with the reasonable suspicion that you had violated the law or with some other good cause, then the stop was legal.

    What does the police report say as to the reason for making contact with you?

    Default illegal stop

    dont know yet, but i was doing nothing illegal at the time he siezed me. at best he might have thought that i was trying to cut into the line of flowing traffic which is not illegal. had i not been drinking which he didnt know at the time what would have been the charge, trying to get cutsies? I was completely stopped when he noticed me.

    Based on where I was. Im not sure what his reasonable suspicion would have been. Again Reasonable suspicion of what trying to cut in line which is not illegal. Of course Im not a Lawyer but I have never heard of a law that states you cant cut in line. Otherwise our freeways would be full of people pulled over for cutting in line.

    Another possible way to look at "cutting in line" is "failure to yield right-of-way".

    Obstructing traffic ... unsafe turn ... there could be a host of reasons to make the stop. Traffic on the roadway is not "a line" similar to that at the grocery store.

    i agree, except that at the time he saw me i was parked not even moving. Not trying to be arguementitive just trying to prove my side.
