My question involves collection proceedings in the State of: Illinois
I defaulted on an online payday loan. They sent me an email that my debt would be sold Spet. 18,2009 to a third party collections. I never gave them an actual check but agreed to withdraws from account. I got a call from a company from Florida claiming that I had to pay the debt by 8pm or someone would be coming to my home or work. That I would be charged with a class a felony. They wanted me to send the money by Western Unoin or Moneygram.
I have tried to reach the orginal creditor but they will not respond and they are no longer doing new payday loans. Can I be arrested for for this? I have read on a website for Illinois payday loans that you can not be tried criminally for defaulting on payday loans. I know that I can be sued in small claims.
