    Post H1 to H4 to H1

    Please help me out

    I am on H1-B and have my paystubs till current. I am out of project now and would like to transfer to H4.

    Q1. How much time it takes to covert from H1 - H4 ?

    Q2. Do i have to run the pay stubs when once i file for H4 and before the h4 getting approved ?

    Q3. What will be the status of mine ( from filing the H4 till H4 getting approved) ?

    Q4. After H4 getting approved if my employer cancels my H1- B then ( if i get the job when i am on H4, is there a way to convert back to H1-B) ??

    Q5. Willl i fall in new Quota and shud i have to apply for New H1 and will i fall in lottery again ??

    Q6. If the H1 is cancelled if i get a new job when i am on H4 can i change to H1 on that employer ??

    Please guide me through all my queries at the earliest.

    You are out of status. Once you are out of status, a change of status requires you to exit the US and reenter with proper stamping. The longer you remiain out of status, the more likely you are to have difficulties in the future.

    Your questions are quite basic. It is obvious that neither you nor your spouse - since you are eligible for H4 - understands the rules and regulations governing theH-1B program. Read the USCIS documentation. If you are unable to understand it, consult with an attorney to have him explain it to you.
