I got laid off on Friday and I am on H1B . I read that the day you got laid off you will be "out of status" . My company gave me Mutual separation and release agreement which they want me sign and send them within 10 days . Having said that I had last two paystubs plus I will be getting new paystubs.
There is no such thing called "grace period" but if I am able to find an employer who is willing to Transfer my H1B . Will it be okay ? is it really called a transfer or they will be filing my new H1B . Also , since INS asks for latest paystubs I can give my last paystubs and will be able to process my H1B right ?
Also , After getting receipt with new company , is it legal to start work as I will be getting H1B approval in 6 months for regular or 2months for premium processing .
My wife is also 7 month pregnant and she is due in December. Is there any legal ground I can make, because she can’t travel and she need insurance. Employer is ready to give me COBRA but I heard it is too expansive ... how much I have no idea...
