    Default Technical Violation

    My question involves criminal law for the state of: Florida

    Hey guys, i've got a quick question for you.
    I was sentenced to 6 Months in Jail, and 5 years of Probation following for Burglary of an Unoccupied Residence, and Burglary of a Conveyance.
    I was sentenced as a youthful offender (not sure what that entails).
    I've been out of jail and on probation for a little over 6 months.

    Today I failed a random drug test, which i know to be a technical violation.
    What can i expect to happen now? Will i get arrested and go back to jail?
    I heard that i will get arrested and have a hearing where the judge will decide what to do with me.

    What are the most likely outcomes for this situation? I'm really stressed and need some kind of direction on this matter.

    If the po choose to volatie you then yes you will be arrested and have a hearing.It depends on the judge,da,etc,you can be senteced to some time in jail,put back on probation,etc. . Idk if techincail a good word to use,it's a crime related what you were conviced of but it's not something illegal but very minor like a simple traffic volaton or something. Having a lawyer at your hearing could help. Some offer free consulation,maybe a local lawyer can make an educated guess on what normally happens in a suatation like yours.

    I know for a fact that failing a drug test is a technical violation. Whether it be illegal or not, i didn't violate by being charged with another crime. I just want some idea of what im going to be facing. I've heard from some people that it's unlikely they will send me to prison for a "technical" violation. People that i know seem to think that maybe they will extend my probation or add on drug court..any thoughts?

    I'm not sure,it meant to put that it's help that you volatied b.c of smoking and not something realted to charge. I know ppl who volatied b.c of smoking and they extended there probation,it depends on your local court or if you have a strict po.
