    Default Parking Ticket for Blocking an Architectural Improvement

    My question involves a traffic citation from the state of: Texas
    We got in the mail a notice of arrest for a parking ticket.
    We called the number on the letter and they then referred us to the prosecutor. and he wasnt in the office. So we asked the lady to look up the case number and she did. it was a parking ticket in a parking lot at books a million. on my motorcycle. it was parked in a yellow stripped area. and the person took pictures of it and that is how the found out ( license Plate ) who it belonged too. there insist a sign saying No Parking. and its on private property. managed by Beer Wells Co. we went today and talked to the Manager of Books a Million he he said he didnt have a clue about people getting ticketed in the parking lot. in the morning i have to talk to this Prosecutor. just was wondering what i had to stand on... the fine is around 1100.00 i cant believe it, i went and took pictures of the area today. Just was wondering is there something out there that could help me on this. Sounds like big brother is out to get us all.

    The law that was on the violation would be helpful, but I found it here.

    The max fine is $500. The pertinent wording in the statute is...

    (a) A person commits an offense if:

    ...

    (c) A person commits an offense if the person stands a vehicle so that the vehicle blocks an architectural improvement designed to aid persons with disabilities, including an access aisle or curb ramp.

    ...

    (g) Except as provided by Subsections (h)-(k), an offense under this section is a misdemeanor punishable by a fine of not less than $250 or more than $500.

    So they are saying you blocked a handicap ramp or something. You might want to request a hearing, which it sounds like you already did. Bring all of your evidence to this (informal?) hearing and present it in a respectful manner. If the cop doesn't show, your off! If the cop does show, you will most likely be found "responsible" regardless of any evidence. If that happens, you should request a formal hearing. Not sure about the procedures down in TX though - so you should do some research before going in.


    And yes, big brother is out to get us all. We are slowly being desensitized to the encroachment of the American Police State. Just like slowly boiling water while an unknowing and happy frog swims around in it!

    Well from what i have gathered the person wasn't even a police man but an average joe with a camera. I was less than 25 feet away from my bike at any given time. so if anyone had came up i could have moved it . Thank you i will talk to him in the morning. As far as a cop being at the hearing i don't think that will be the case. Its a case of a camera ( pictures ) against us. We never even got a ticket for this.This is just plain crazy. Chalk one up for ignorance. I will TELL everyone i know and maybe even the television station here we have 3 in the area. There seems that they would give a little on this but with the economy the way it is their out o get us all.

    a picture taken by a person who is not an authorized representative of the state is not admissable

    chances are, there is no dated, witnessed film, either ..

    no evidence, no witness , NO CASE
