    Default Forced to Come to Work in the Office Even Though I Could Work from Home

    In the State of Arizona
    I injuried my back on the job 6/2009 and diagnosed with herinated disc in lower back. Insurance doctor put me on restrictions, No lifting over 10lbs, no bending, and sitting 50% of time after telling him I could not sit in a chair or stand. My question is, If I normally worked from home and not at the office, but the employer insist that I work at the office, Would I have a good complaint with ADA or EEOC for disability discrimination? Also I was on FMLA and the job kept calling and sending me letter's to come in to work and that they had modified work. I worked 1 day but couldn't do it b/c I couldn't bare the pain. I could of did the work from my bed on my laptop.

    Are you stating that prior to your injury you worked at home, and now your employer wants you to come to the office? Nothing else has happened except for the injury? No changes in your productivity? No global changes of your employer's policies on working from home? When you asked what motivated the change in policy, how did your employer respond? Are you stating that you are being made to come into the office in violation of your work restrictions, or that your restrictions have been lifted and they can now accommodate you but you prefer working at home?

    Hey Mr. Knowitall,
    Thanks for answering this for me. No Changes at all from my Employer. Well I only work at home or out in the community with the clients. I only came to the office for training classes or oreintations. All my doctor said is I could work with those restrictions but why should I had to come to the office when I could of did it from home. It was very stupid of me to not ask my boss that before I resigned, but know it is really eating me up on the inside. Would I have a good claim with eeoc?
