    Default The New "Guest Worker" Law

    Hello,

    I just heard that Congress approved Presdent Bush's new Bill "Guest Worker", What is it? cause my employer already applied for a Labor Certifaction (ETA 750) and wants to know what the Guest worker program is all about and if he should Cancel on what he is doing (trying to get a H2B) and apply for the Guest Worker thing.

    In my opinion, the guest worker program is a sham to get cheap employees for businesses who don't want to pay the market rate for labor, while avoiding giving the "guest worker" any immigration rights.

    Your friend should keep working on the H1 angle, first because a "guest worker" program is about unskilled workers, and second because he would likely make a lot more money if admitted as a skilled worker than if admitted in a category meant for unskilled workers. (And even then, under legislation that is not even in final form, let alone part of U.S. law.)

    Oh, well I can't apply for a SKILLED worker because I am not a Skilled worker lol. I am a UNSKILLED worker and well I was hired from a U.S. Employer at their Resterant in the States. My Employer said that he called USCIS and they said to apply for a H2B visa (this is before the "Guest worker" thing ever came up), thats why Im asking what and if I should apply for a "Guest Worker"??

    You can't apply until there's a law.

    Sorry I missed the classification - but still, get some skills, you'll be better off. 8)

    lol alright lol, so what your saying it's not "Offical" yet (or may not be)? also I heard its only for illegal immirgites and if they were here before 2004?...

    The present proposal seems pretty horrendous....

    People illegally in the country who are employed can ask their employers to apply for guest worker permits/visas on their behalf. Their employers may decline, in which case they can't get one. (And an employer who runs a sweatshop, doesn't pay employment taxes, and has substandard working conditions would seem to have an incentive not to ask for permits.) That also seems to do nothing for illegal immigrants who are self-employed or who do short-term jobs, for example, in construction or landscaping.

    Otherwise, the benefit goes to employers who bring in new workers from outside of the U.S.

    Oh ic, well because my Employer hired me back in Early Febuary and he applied for a ETA 750 Form (for H2B Visa) and we haven't received any feedback if approved or not, thats why he asked if there is an "Easier" way to get me to work for him. He needs employees and he asked about the "Guest worker", he wants me to become a Waiter so really I called USCIS and they had no idea what im asking and they said that there is no bill passed.

    So you think what Im doing right now is a good proper way for me to work for him or do you think the "guest worker" could be the best bet if Avaiable soon...

    You response towards the new bill doesn't seem good lol.

    I don't see any good in it. It could potentially transform the majority of illegal immigrants who are presently working in this nation into an invisible population of serfs, unable to assert any rights under labor laws because their employers refuse to sponsor them, while setting up a population of "legal immigrant labor" no better integrated into society than that of nations which use similar "guest worker" programs - like France.

    For somebody who wants a summer job or short-term employment and can't get in on anoter visa program, it may not be so bad. But I think it's lousy policy for everybody except large businesses which don't want to pay the market price for labor.
