    Angry How to Enforce Battery Charges

    My question involves criminal law for the state of: ALabama
    I recently went with my fiance to take his son home (the ex has custody) from a doctor's visit. She lives in the country with no nearby neighbors. We had been playing outside with the children (girl 6, son 14) and visiting. When the exes went in to talk the kids also went in to play a video game. I didn't go in because she has bitter feeling for me and I didn't want to make matters worse. My fiance was discussing plans with her about taking the kids to the beach the following weekend. I had to urinate terribly bad so I walked into the doorway. The main door was open but the screen door was closed. They were in such deep disagreement (as usual) I didn't want to interupt and she didn't immediately ask me to leave so the son told me I could use his restroom. After coming out the children asked me to watch them on their video game. I again stood at the doorway. After about 10 minutes the Ex wife went into a cussing spree asking me to leave. As I turned to reach for the doorknob (right behind me) she blindsided me. She ended up pulling me to ground, injuring my arm, biting my right thumb and breaking my glasses (irrepairable). I have photos. She even admitted attacking me first in the police report. I did not fight her back & begged her to quit b/c the children were crying & screaming. I called the city clerk today and she said she does not even think there is probable cause for a hearing b/c I was on HER property. I told her this was unacceptable I WAS ASSAULTED AND WANT JUSTICE! Any thoughts/advice!? Thanks!

    The deputy told me he thought I had a very good case for several different reasons. The first being that she admitted she initiated the fight. The second being how uncooperative she was with the two deputies there. I also had a witness to show that no matter how long I remained inside the doorway I immediately went to leave when she requested it. Even afterwards I stayed in her yard awaiting the arrival of law enforcement and she never asked me to leave her property. We both had called 911.
