    Default Out of Court Agreement

    State of California.

    After a contract dispute, an agreement was reached out of court between myself and the lawyer representing a former client. They agreed to pay the outstanding balance owed to me.

    Now the lawyer is coming up with excuse after excuse on why he hasn't yet sent the money to me, stating that he has higher priorities to deal with at the moment.

    This has been a painful process lasting months and my patience has run out. What can I do to get the lawyer to hold up his end and pay me?

    When you say "an agreement was reached" what exactly do you mean? A handshake deal? A written memorandum? A consent judgment subsequently entered by the court? Did you dismiss your court case?

    I mean there was a great deal of discussion between myself and the other side's lawyer, and they agreed to pay me the outstanding balance so it wouldn't have to go to court.

    It was basically a series of conversations we had in which I dismantled all excuses from their side for not paying me, and they finally gave in.

    Did you dismiss your case based upon this handshake deal?

    Can you get them to confirm the deal in writing, ideally along with a payment schedule?

    From your description it would seem that this never went to court.

    I would say that you have have been very reasonable but that your patience and good nature has been abused. I would set them a deadline, and failing the deadline, I would commence a civil action.
