    Default Police Phone Call

    My question involves criminal law for the state of: Florida

    My friend was taking part in a drug deal for a couple pills. He waited in his car in a parking lot and his connection came to the car and got the money and said that he would be back soon because he wasn't currently holding them and had to get them from another guy. His connection walked away and said he would be back in 5 minutes. After ten minutes my friend called him and his connection said "give me 2 minutes i am waking this guy up". Another ten minutes pass and my friend calls him again. This time a man asked who was calling and my friend gave his name. The person on the phone said he was detective ********* with the police. He informed my friend that the person who owns this phone was involved in an undercover drug sting and said they had been watching this place for 6 months and said that the recently arrested person asked that if someone called they be be informed what happened and to contact his girlfriend. The officer then accused my friend of being involved in the drug deal because he was calling the same time as the person was arrested for drugs. My friend said that the person arrested was just a friend and didn't even know that he did drugs and was just calling to see what he was up to today. The officer said it couldnt be a coincidence and that if my friend was involved in the drug deal he would find out. He pressed for more information and for my friend to confess, but he didnt. The officer didnt even make my friend give a last name. My friend is very scared because this is something he hardly ever does and wants to know if its possible for any charges to be brought against them or if the police can do anything at all to him, especially if the person arrested says that he was getting stuff for my friend. Im sorry this was so long, but i promised my friend i would try to find something out. Any help would be greatly appreciated. Thank you.

    your friend needs to keep quiet and not admit anything. The cops can lie or try to trick him and say they know more info then do. If he is arrested he should be quiet and ask for a lawyer. Normally they care more about dealer. It depends thou.

    Thank you for your response. My friend just relayed this information to me...The cop also told him over the phone that they were going to turn over the phone and other personal belongings of the person they just arrested over to the guys friend. My friend wants to know if this means that the police are done with the phone, and also by extension, my friend? Can the police arrest you if its just another persons word against yours? There is no evidence and nothing tying my friend to the drugs. Thank you for your help.

    Listen man this all sounds like there was never a real cop... You just got beat and they told you they were cops to scare you and to not pursue them. I've seen this happen before and it is almost guarenteed it was not a police officer. Sorry that you had to deal with a scumbag dealer although pills are bad for you. At least it wasn't a real cop haha. Good luck man be careful who you deal with if you really have to do stuff like that.

    He says it was for $55. He still has yet to hear from any members of law enforcement and as of today has no warrant for his arrest. Still operating under the assumption that he was not screwed over by his connection and did in fact talk to police, do you think they would have contacted him by now or put out a warrant if this was for real?

    That's true,the op is probably right also. If your gonna buy drugs its good to know the person well and not hand them the money before you see the stuff. It's best just avoid all the crap or at least not deal w. shady ppl.

    this guy was telling me his hard story and it seems he took his home theater stuff into the shady side of town

    he met up with a guy who said
    "how do i know this stuff really works"
    he said he wanted to take it and go plug it in to make sure it worked
    the guy took the stuff and went around the corner

    First of all, good for your friend for not confessing. There may not have been a real cop, or it may have been a cop and if the connection is charged he could rat on your friend and yes, that would be enough to charge him, he got the money, that's consideration for drugs. My first thought though was that the connection was a CI and the cop may have just been thinking he was slick and taking a chance trying to get info from your friend, trying to give him the connection's stuff could have been just a way to get face to face with him. No, cops don't make arrests and try to give things to the criminal's buddy, but they do try to get info, the do try to get your friend to say, "hey, did he have my $55? too?" If this was a rip off why would an attempt at contact be made? It says nothing that he hasn't been "contacted" or that a warrant hasn't been "put out", how does your friend know there isn't a warrant? Often with CIs the cops will either wait to get a warrant and/or get one asap but just wait until the suspect is pulled over or something in an attempt to preserve the CIs confidentiality. That may be the case here, especially because if the connection was a CI, this cop obviously blew his confidentiality, the cops think ok your friend is a drug dealer, 6 months or a year from now he will have made so many other drug deals we'll arrest him and he won't be able to think of who the informant was. Trust me, this happens they'll wait to get a warrant, and then the warrant will sit, they're not necessarily going to knock on doors. I think it's absurd especially when someone gets pulled over for a headlight a year later and ends up in jail on felony charges when if they had just known they were wanted they could have turned themselves in when they weren't on their way to work or pick up the kids or whatever. I suggest that your friend lay beyond low, no drugs, no deals, no shady people, no speeding, no burnt out headlights... and when the time is as good as ever [i.e. he has 24 hours to spend in jail and can bond out] he should find out if there's a warrant, get a lawyer, turn himself him, and continue not to talk at all without his attorney present

    Yeah, my buddy did not admit to anything. And he has never sold drugs in his life. Why would you infer that he is a dealer if he is buying a few pills for personal use? He is just a user. Im happy to say though that the situation scared him straight and he hasnt touched anything since the incident which was over a month ago. Hes even going to NA meetings. To answer your question, if this was just a rip off, when my friend called again to check on his progress, having one of the connections friends impersonate a police officer would let the connection get away with the money because my friend would be worrying about his own a** getting arrested instead of trying to get the money back.

    He hasn't been contacted by any member of law enforcement and he knows he doesnt have a warrant because this county has a way to check online if you have a warrant. He apparently checks every day and there is no record of a warrant. Seeing as though he isn't a dealer, in most cases would they have already issued a warrant by now (if he did indeed talk to an actual cop), since it has been over a month since this incident occured?
    Thanks to all those who responded. Any more feedback on this would be much appreciated.
