My question involves judgment recovery in the State of: Idaho
Yesterday we had our account (which held our mortgage payment) garnished due to a judgement that was placed on us about 5 months ago. It was medical debt, which my husband had a change of careers due to a medical emergency (was bed ridden for 8 months) and has not found an alt job as of yet.
I am self employed (which my husband was too until his back surgery) and they took the account from $1700.00 to $130.00. We are also on state aid due to our income being cut in half and medicaid for our children due to our current very low income status. We are in the middle of a home loan modification trial because we are very past due all because of his medical emergency (insurance deemed pre-existing). I just made our mortgage payment via phone so they should be taking the payment, now attempting to, any day. So my concern is to get it recovered, if possible, as soon as I can.
I've had a hard time determining whether any of our funds would be considered exempt due to us being self employed. This happened on a Saturday so I have not been able to contact the sheriffs office yet (bank told me to contact them first) and bank could provide further information.
Any suggestions would be greatly appreciated...
