    Default Statute of Limitations Assault and Battery

    My question involves criminal law for the state of: California

    I was Assaulted at a party almost two years ago. The off duty police officer who was helping to stop the incident gave me the advice not to press charges for Assault and Battery because it was a family member, so I did not file charges. Now nearly two years later the situation has grown into other family related problems.

    I am wondering if it is too late to file charges so as to have a court hearing to get at the truth. Statute of limitations Assault and Battery

    If this battery did not require any medical treatment, then the SOL likely passed after one year.

    Even if you could pursue charges, what would that do now? He'd get probation and fines ... MAYBE, up to 6 months in jail if he ticked off the judge somehow or had a criminal history of note.

    I am afraid you will have to deal with the drama in the family in some other way.
