    Default I-130 Withdrawn, Divorce, and Visa Overstay

    State: CA

    I married a USC after she became pregnant. I decided to leave her and she filed for divorce. She also sent a certified letter to withdraw the I-130. I have overstayed my Tourist Visa, and my case is still pending. I had to cancel my 1st interview since she wouldn't come with me for obvious reasons. Am I here illegally?

    You overstayed your visa, and blew off the adjustment of status process? Is there any theory you can think of where you could possibly be in status?
