    Exclamation Child Custody - 24yr Old vs 16yr Old

    My question involves a child custody case from the State of: California


    Hello and thanks in advance for any and all help.

    I am a 24 year old man and recently had a baby with a 16 year old girl.
    The baby is now 2 months old. Ive been helping the mom since her pregnancy and we have not had any big problems. Recently the mom's mom (the grandmother) got upset with me, and now she doesn't want me to see my child. The baby's mother wants me to be with the baby but her mom is telling her that if she lets me see the baby she's going to kick the her out of the house.

    Can the grandmother do this? What can i do about this situation??

    Can i obtain custody in court?? Full, Joint, None ????

    The baby's mother is 16 and is going to school. she depends entirely of her mother, and could not possibly support the baby herself.
    I am 24, i have a job, my own place, a crib for the baby and everything else she needs.

    A couple of points.

    -I have a misdemeanor for violence in a unrelated incident.

    The baby stays in a house where:
    - Theres drugs. The brother smokes weed almost every day and is a convicted sureno gang member. He also has guns. He's 18.
    - The house is in horrible shape, a housing unit, with roaches and rats.
    - The baby doesn't have her own crib, she sleeps with the mom in her bed. The room is very dirty, trash and clothes all over the floor, cant even see the floor, no exaggeration.
    - The grandmother has slapped and kick out the baby's mother more than once since i known them but before the baby was born.
    - The grandmother doesn't work, she gets housing and money from the government.
    - The grandfather passed away.
    - The baby's mother has been physically and verbally abusive to me.

    Does any of this matters??? what does and what doesn't.

    What can i do? what are my options??

    I haven't seen the bay in a couple of days. I love her and want to support her, but most importantly I want see her and spend time with her.
    My family is also upset about this situation.

    Please help!

    I haven't seen her. I miss her. I can't just forget about her.

    You need to consult with an attorney ASAP.

    The very first thing you need to ask about will be your age difference. I don't have the time right now to look it up, but since you are 24 and the mother is only 16, you have most likely committed a crime by engaging in a sexual relationship with a minor.

    Thank you for your reply.

    I know the age difference is a major issue. I'm almost certain that in every state its against the law for us to have had sex. But I met the mother in a party in which she lied to everyone and said she was 18. We had a 1 night stand and she ended up getting pregnant.

    If anybody can provide any more feedback on this issue or on the other issues i mentioned, i would GREATLY APPRECIATE IT!.

    Pretending the age issue is nonexistent - unless the mother does something that is a direct danger to the child it is highly unlikely that you would be given full custody. And it is also highly unlikely that unless you are a danger to the child that the mother would get full custody either. You both would share custody IF the age thing was nonexistent... but seeing how a probable sex crime has been committed you NEED a lawyer ASAP.

    Just as a warning- my son was 18 when he met a girl who said she was 17, almost 18, even her parents told my son, and me this. However, she was not 17, she was 15. The end result, my son has been in prison for over 10 yrs because of the girl's and her parents' lies.

    The reason I posted this is to let you know that ignorance of a minor's true age and a minor's lies are NOT a defense against any criminal charges.

    As I said in my first post, get a consult before doing anything.

    Have you been established, in a court of law, as the father of the child?

    have you filed for visitation?

    Thank You all for your post, i am very grateful for any help i get.

    I understand I am in a very complicated situation because of the age difference between me and the mother, and yes I understand i can go to jail because of it, but I am only looking for the best solution for my daughter.

    I want to be a part of my daughters life and wish to support her in every way.

    In terms of court nothing has been done so far, on my side, but the baby's mother tells me that Her mother is going to file for full custody.

    I get along good with the baby's mother and she wants me to be with the baby, but she feels scared and helpless because her mother keeps on threatening to kick her out of the house (she's done it before a couple of times, but before the baby was born) if she lets me see the baby.

    Is there anything she (the baby's mother) could do to help out?
    Is there anything my family could do to help out??

    Also I wanted to mention that the grandmother recently (about a month) was abusive to her boyfriend, she slapped him so hard she broke her pinky, I was there, she even went to the hospital to have her hand checked out, and they ended up breaking up because of it. Since i had became good friends with him, i helped him move his stuff out and continue to hangout with him. I think ( i am not sure) thats the reason the grandmother doesn't want me around anymore.


    I want to file for custody (joint), but I am afraid of the consequences that it might bring. I can't help my daughter if I am in jail .

    I plan to consult with an attorney soon even do i really can't afford one.

    If anyone has anymore advice, please help. I haven't seen my daughter in over a week .

    Call the bar association and ask for a referral. Most give a free 30 minute consultation.
