    Default My Ex Changed My Childs Name

    I have a child with my Ex.We had one child together.We agreeded that she had Sole Custody of the child and I wouldn't be in the picture.Later she remarried and my Ex took on her new husbands last name.Now I found out today that my child by her has her husbands last name as well.My question is ,I thought they would have to contact me if he adopted my child.I never have been contacted about it.My question is...Is this legal? and could it be done with out even contacting me?How can I find out if he adopted her with disturbing the family?-Thanks

    What does it matter if you don't want to be in the picture?

    It is possible though the legal requirements for notice may have been satisfied by publication for the name change.

    A name change can be done without an official adoption and without your consent if she has full legal guardianship.
    But, if the stepdad officially adopted the child through the courts, he assumed responsibility for the child's support and you would no longer be obligated to pay support. In Florida anyway, for an official adoption they would have also issued a new birth certificate replacing your information with his as the biological father.

    If you agreed your ex had sole custody and you wouldn't be in the picture, then why do you care if the new husband adopted your daughter? You want to know if this is legal and if there's a way to find this out w/out disturbing the family...WHY? I'm guessing your ex having sole custody & you not being in the picture meant no legal or financial obligation on your part, and since girls usually change their names when they marry, she'd likely change hers when she marries, it's not like she's going to carry on YOUR name. Why not just let it be. It's obvious you didn't want anything to do w/your daughter so what's the big deal now about this?

    Why it is brought up is.I carry my child on my insurance.I send the Insurance card in every time it is re-newed to the courts like I'm suppose to do because the Ex tried to put my child with her on Mead-Cad anyway.I get a letter from the courts and I had to call them and they said that they were no longer involved in the matter and the case was closed and that if the Ex wanted the Insurance Card than I would have to send it directly to her....which I have no idel where she is at.So something has happen and all I know is that my child is going by my Ex second husband last name...
