    Default Commercial Building Tenant Issues

    My question involves an eviction in the state of: California

    I own a commercial building and the tenant is a machine shop. Due to the economy the rent was lowered from $10,000 per month to an agreed $8,000 per month, and the machine shop is still not able to pay there rent. They still owe rent for the previous month, this month, and upcoming rent in october.

    Can you please tell me what I should do? Can I put a lien on his machines to make sure that if he goes out of business, which is a good possibility, that I can still get my rent?

    Should I evict him?

    any information would really benefit.

    This is a business decision that you have to make based on how viable you think their business is and what your alternatives are for leasing the building if this tenant is evicted. Commercial buildings can take quite a while to lease, as I'm sure you know. If you think the business is doomed, you may want to evict. If you think they may recover when the ecomony improves, and you have no alternatives for leasing the building, you may want to work with them. An empty building is more susceptible to vandalism than a rented one. If you have someone else who appears to be a good tenant with a viable business plan ready and willing to lease the building at a price you consider acceptable, then evict.
