My question involves real estate located in the State of: California
We recently put a new driveway where an old driveway was. Before putting in the new driveway we sent a letter to our the owner of the property next to the driveway telling him we wanted to remove the bushes which were the fence between the driveway and his property. He said we could do that if we paid for the removal and built a new fence at our expense. We agreed to those terms. When the bushes were removed the fence the owner had put up a few years ago to replace an old fence looked as though it had been bumped over a few inches onto our property. We want the extension of the fence to go back on the property line. The owner of the property wants the fence to go directly up against the driveway. We could not agree. He then told us that we removed the bushes without his permission and that the driveway is on his property. He also said he would sue us. We called him today to see if these issues could be resolved and he told us his lawyer would contact us by letter.
Would a survey solve these issues or what can we do?
