    Default Any Chances

    Hi,
    My situation is following:
    I am originally from Russia, came into USA as exchange J-1 student Work and Travel on May,2008. Later i decided to change my visa to F-1 and was refused. And in April,2009 I got married to US Citizen( with him we are together already since May,2008). Now we are waiting for a child - 8 months pregnant. We love each other too much. When we were going to apply for my Green Card he was laid off and we hadnt money for the whole process. Now after the baby is born we are going to apply finally. Now I am illegal here. What chances that GC will be approved? Thank you in advance.

    If you entered legally (which it looks like you did) and overstayed, and your marriage is legitimate (not just for immigration) then the overstay should not be a problem with adjusting your status based on the marriage to a US citizen.

    However, what you have to consider is what you did while you overstayed. Did you work illegally? Did you obtain/use and fraudulent documents? Did you pay taxes? Did you commit any crimes? These things could cause problems with the process.
