    Default Removal Proceedings, When Married to U.S. Citizen

    My husband and I got married over a year ago, before I fell out of status and the removal proceedings. I have been in the country for 7 years now andgot my passport taken by ICE about 3 months ago since I am out of status. When they took my passport they advised me to send in the GC papers as soon as possible. We finally saved money and sent them 2 months ago. Now I have the removal hearing on Oct 1st, I can't afford a lawyer and need some advise. Am I gonna be kicked out of the country? I have been here for seven years and never fell out of status and have no criminal record. Is there anything I can do that can help? Is not having a lawyer really bad? What should I expect? Please Help! I live in Massachusetts.

    In spite of having no money for an attorney, you need to talk to one. Most attorneys offer a free initial consultation.

    Did you enter legally, and then just overstay? You sent in your I-130 and I-485 two months ago? Did you receive acknowledgment that they've been received?

    If you have, take that paper to the removal hearing with you, as well as your marriage certificate.

    We cannot tell you if you'll be sent back to your homeland or not. We cannot predict your outcome. You NEED counsel.
