The State Of Texas

My son's father just moved in with a woman who is on $100,000 bond awaiting trial for Attempted Aggravated Assault of a Peace Officer. That charge is reduced from Attempted Capital Murder of a Peace Officer.

Basically, in June, at about 1 am, she tried to run a police officer (and several witnesses) over that were on the side of the road investigating a hit and run. (She is suspected as the the one who hit and ran from that accident.) The official press release says she came at them at a "high rate of speed" and "swerved toward" the people after they first moved out the way. The officer fired two shots, missing her but striking the vehicle. She continued on but was caught and arrested a short time later.

She is on disability for mental reasons (bipolar that I know of) and has a past history of drug abuse.

My son's father claims the charges will be dropped but his story sounds shaky at best. Basically, he doesn't had one, he's just insisted that the da and detective both told her she has a civil case against the department and charges were only filed because a firearm was used. I'm not buying it.

What kind of penalties does this charge carry if she's convicted? Is it likely it could be dismissed even though she was already arraigned and bail was set? About how long until the trial? I know that varies but a rough estimate would be appreciated. Who, if anyone, can I contact for more information about this case?

Thanks!
