    Default Turning Left After Red Light

    My question involves an injury that occurred in the state of:

    I was turning left on a red light in an intersection. One car in the oncoming traffic stopped at the red light and the next car in the outside lane was approaching the intersection. I turned left and hit the second car as it went throught the red light. After I made my turn, I was looking for pedestrians and didn't see the car in my peripheral vision as it went through the red light. I made my turn after the light had turned red.

    Because I turned left on a red light, do I have any liability? The other car obviously does because it went through a red light. I have a witness who will vouch for my account, but the cops wouldn't take a report.

    I don't know about all states or your state which you didn't mention but in my state (Il.) you can't make a left turn on red whether anyone is coming or not.

    It depends on the laws of your state. It would be a good advised though to consult a lawyer to determine your liability, if any.

    You don't say what State you are from. In Utah, and all States I'm aware of, you may not turn left on a red light. It is legal to turn left on a red light if you entered the intersection when the light was green or yellow.

    Each driver in the car crash is assigned a percentage of fault. Running a red light is good evidence that a person is at fault. So if the other driver ran a red light, the other driver should be assigned some fault.

    At the same time, you should have looked before turning left. You are entitled to assume that other vehicles will objey traffic signals but you should also be careful when turning left.

    That being said, I would expect that if the other driver ran the red light and you did not, the other driver will get a high percentage of fault and you will get a low percentage of fault, if any.
