    Default Mandatory Sick Day

    In Illinois: In the advent of the flu season, we want to mandate that any staff coughing, feverish, or complaining of feeling ill go home for a minimum of 24 hrs, using a paid sick day, only if they have one. If they don't the time off is unpaid. If they choose to go to the doctor, they must provide us a release from their physician to return to work.

    We are in a private health club setting and want to take all precautions to ensure everyone's safety.

    Any problems with this?

    For non-exempt employees, no, I don't see any problems.

    For exempt employees, the only problem I see is IF you do not offer at least 5 paid sick days. If you do not, then the only potential issue is if you require to take the day unpaid, which would violate the FLSA. However, if you do offer a minimum of 5 paid sick days, I see no problems for exempt employees either. And if you don't offer at least 5 paid sick days but you pay the exempt employees for any mandated sick days, you're clear for that too.

    That being said, I'd keep a very close eye on this as such a policy has a potential for abuse
