    Default 13 Year Old Charged With Disorderly Conduct in School

    My friends 13 yr old daughter was being harrassed at school by another girl.Last Fri. the girl confronted her in the hall and they had a push/shove match.The entire incident was caught on tape showing the other girl provoked the incident.Nobody from the school contacted my friend to discuss the incident and before she could contact the school the following Mon. she received a call that police were at the school and her daughter was being arrested for disorderly contact and possible battery.Both girls were arrested and brought out in handcuffs at the end of school in front of all the children and parents.She was brought to a juv. det. center and processed.Is this legal?This is an A/B student,involved in sports,and has never given anybody trouble.I just don't understand how this can happen!!Any advice would be greatly appreciated.

    From what you wrote here it seems like the girl could have walked away but she chose to participate. It does not sound like self defense and therefore having charges filed seems a reasonable outcome.

    Yes. Why wouldn't it be? Fighting in school is not only grounds for arrest on charges of disorderly conduct, it's also usually a Safe Schools violation AND runs afoul of the Zero Tolerance policies in place in many school districts nationwide.

    I just don't understand how this can happen!!
    You might ask the student in question why she continued to engage instead of walking away.

    Fair enough! I guess some of us are still living in the times when a fight at school meant a trip to the principles office and the long walk home to face Mom & Dad. A lot easier than courts,judges,and juvie halls.Sad!!
