    Default MIP and Open Container

    My question involves criminal law for the state of: SC

    I was riding home the other night with a friend and we got pulled over. My friend had to do a field sobriety test and passed while he was doing the test the other officer asked me to step out of the car. They searched the car and found an open container. I got 2 citations one for open container and one for MIP. This is my first offense of anything like this. I heard about the Alcohol Education Program(AEP) for first offenders to get it off my record and I qualify for it I am 20 and i go to school. Do I need to talk to an attorney or what I just need some guidance on how to go about this.

    If you are comfortable doing so you can go to your arraignment and see if you can get into a AEP program at that time; if not, you can plead "not guilty" and schedule additional proceedings at which time you can bring in a lawyer. Note, however, that some jurisdictions don't have a prosecutor present for arraignments, and if that's the case you won't be able to plea bargain at that time.
