I recently purchased a house in a gated lake community. I purchased the home as a contract for deed as I wait a few months to settle an old account so I can obtain a mortgage. The IRS considers the Contract for Deed as financing and I will get the firt time home buyers credit ($8000). The association advised me that it was "fancy term for renting" and they stated renting is not allowed. The access to the house can only be obtained through a gate with a key card or clicker. They have denied me access to key cards or clickers. They will not set up the community water in my name, and will not give me acess to the local post office they have for residents. I already took possession of the property and have been using a friends extra clicker. The association said they will wait a few weeks before making any desicions on what they will further do. Any advice if they can actually deny me access to my home, and the association by-laws only state that owners cannot RENT. Nothing is said about contract for deeds that i dont think they are familar with. Also this association owns the lakes and property surrounding the homes including the paved roads. Its one way in and one way out. Its a developer that owns it.
