I signed a lease agreement in January. My husbands name was listed as a tenant but he did not sign. In June we were told that the house was being put up for sale and we needed to find new housing. Which was fine with us because I have been sick and out of work. We ended up moving out and returning the keys 8-19-09. I failed to pay July and Aug rent. I agree that I owe it. He is saying he wont deduct my deposit of 450.00 even though the house was clean. And now he is suing both me and my husband in small claims. My husband is the only one working and I'm afraid that they will end up garnishing his wages. But he did not sign. Can they garnish his pay without him signing the lease?
