I apologize, in advance, for lengthy story.

I hope I can explain this clearly so some one can possibly assist me. 5 years ago, my now ex-husband had to get onto LT Disability through his company. A voluntary policy he paid monthly premiums for. At the time, we lived in another state but moved back home when we lost everything. Of that 5 years, we have been divorced nearly 4 ½ years (don’t bite me…he left me haa haa). He gets $2,782 every month from Standard Insurance Company. He was ordered to pay me $450 a month in child support (yes he was supposed to pay more but that was all he could afford with all his enormous medical expenses), which obviously paid from his L.T.D. from Standard. He lived off of the LTD income minus the child support. We did not! I have had to work 2 jobs most of the time to keep my two teen boys and myself from drowning. I got NO NADA NOTHING (including insurances, school supplies or anything otherwise) from him outside of that $450.

Fast-forward 4 ½ years and he FINALLY gets social security disability after the 5 year battle. He was only eligible for 1 year back pay which he said he got $21,000+ (which he said he had to pay all back to Standard Insurance Company). Then he later tells me that my two sons will be eligible for back pay for that one year also (besides the $430 they each will be receiving each month (what he should have been paying in child support). They were to each get $6,700 in back pay for the one year.

I was elated because they have had to do without for so long now it is really pathetic. I shop at Goodwill for their clothing….. Can only buy one school uniform at the beginning of the new wear…. They have to wear last year’s shoes… (Not easy to do when you are 6’3” tall and wear a size 14 super wide shoe!!). You get the picture….

I was hoping to put aside the majority of that money for college and a second hand vehicle for my son to drive back and forth to college. We currently share a 10 year old Toyota. The Ex has a nice sporty new 4 wheel drive truck….

Anywho, I will try to make this long story short… Ex husband calls and says that Standard Insurance Company wants ALLLLLLLL of both of my sons one year of back pay! He said he signed (and later said I also signed which I have no recollection of) saying we would give up all monies received from social security disability, including my children’s. That was the only way he could get the long term disability.

Before all this drama took place and I had done my children’s claim over the phone. I had given the social security disability worker my checking account info and they boy’s money will be directly deposited into my checking around October 15th.

Can Standard Insurance Company have my wages garnished (a whopping $7.50 an hour!) or my checking account frozen. Can they force me to write a check for the whole amount? Are they truly entitled to all this money since my sons have done without and their Dad has lived off the money, not us!?!?! They need so many basic things like clothing, a small computer for school (my sons are 17 and 13).

No I have not been directly or otherwise contacted by Standard Insurance Company. This is info from my ex. HELP! I am confused! Melanie
