    Exclamation Marriage After Voluntary Departure

    Hello. I have been dating my girlfriend for the past 2 years. She came to the United States legally when she was 8. She and her family signed a Voluntary Departure and left the state, but instead of going back to their country, they moved to another state. I want to get married to her, but I'm afraid that will complicate things even further. If I marry her, will I be able to apply for adjustment of status? I am a US citizen. Is there any other path? I talked to an immigtration lawyer and he told me that since she signed the Voluntary Departure, there is nothing that can be done. Is there no waiver or any other way?

    Why would you not believe a lawyer that specializes in this area of the law?

    I don't because we went to 2 lawyers and both said different things.

    She signed the voluntary departure.

    Then she didn't depart.

    This course of action is not looked upon favorably.

    And if the Dream Act were to be made into a law, would she be eligible?

    We can't tell you whether she'd be eligible under a law that doesn't even exist, yet. If it ever gets passed, THEN you can find out. But it would be unwise to wait around for it.
