    Angry Mental Anguish

    My question involves defamation in the state of: California.

    Today, I was approached by my sister who stated to me that an Employee at Ralph's Supermarket (Kroger Foods) told her that another employee at the store told him that whenever myself and my family enter the store, he should keep an eye on us. The employee stated to him that we were under suspicion of Shoplifting. We have shopped at that store for years and NEVER had any altercations of any kind, and I am OFFENDED that such an accusation would be made about us.

    Neither myself, nor any of my Family members have never been accused of being Criminals and it has caused me to actually lose sleep. I can't believe that they would say something like that about us.

    Would it be JUSTIFIED for me to file a lawsuit against the Company, Manager, and the employee for Defamation of Charater, and /or Slander?

    You can not sue for being "offended". Nor could you prove any damages.
    No you can't collect on mental anguish. And how do you think you are going to get any store employees to repeat that under oath? Yea right.

    Even if a store is incorrect in its inferences, it's not "defamation" for them to suspect you of shoplifting. Nobody has actually accused you of stealing. Now, if they start spreading word in the community that you're suspected shoplifters, that calculus may change; but I doubt that a single mention to your sister would even come close.
