My fiance is from Portugal but was raised here. He was deported in 2007 for Trafficking in drugs, after serving a 4 year sentence. He came back to U.S because his mother was very ill. She is an American Citizen. He was picked up by ICE a few years after his return (8/6/09). He already pleaded guilty to the charge of Re-entry and Concealment of Facts, mainly to receive the points off sentence for "Acceptance of Responsibility." His Judge that he plead to and that will be sentencing him asked him several questions about his past, family, feelings, and life after deportation. The Judge really seemed to care about the case, asking more questions than he did with any other defendants on Re-entry charges. My fiance has several family, friends, employers, and co- workers writing letters to his Judge, Congress, mainly anyone who may listen or may help. Does a Federal Court Judge have the power to allow him (my fiance) to stay in the United States?
Also, I was just reading about Family Reunification Act, from what I read it looks as if it passed through Congress in 2002. Could this Act help in our case? Did it pass?
