    Default "Statement of Loss Sent to Victim"

    State of: CA.

    Hi,

    I was convicted of a wobbler felony on one count of DV in February of this year and have been going through my program: 52 weeks Anger Management classes, 20 hours community service, 37 days house arrest (completed, May), 90 days secured alcohol monitoring (completed, June) and pay my monthly restitution on time. Everything is going in accordance to the court ordered programs and I have not violated any probationary terms.

    I check the county website often however, to see what is going on in the actions/minutes and noticed on September 8 an entry in the journal that read "Statement of Loss Sent to Victim".

    I have no idea what this means and have asked around to some people who I thought would be familiar with the term (others who I have befriended in my Anger Management classes) as well as a friend of mine who is an unemployed lawyer but came up empty. I have also placed a VM to my attorney, but he is a criminal attorney and not a civil attorney so I don't know if he would be able to assist me.

    Can anyone explain to me what this exactly means? I have no idea and am fearing a civil suit and if so, want to be prepared. I'm no law expert (obviously) but the timing of it struck me as odd, as the 25th of this month would be exactly 1 year since the incident.

    Is that for YOUR case? Or could it be for a civil case the victim might be a part of?

    It could be that the victim is seeking restitution and the probation Department sent the victim a form in which to document that loss.

    It is noted on my case as a journal entry and after I searched under both the criminal and civil cases my criminal case is the only one that still popped up.

    That is what I am thinking since it makes sense.

    We lived together for some time and after everything happened and she moved out. We had no contact for about 6 weeks until she contacted me and for about a month we tried to work things out.

    I was no saint during our relationship (this was the first act of violence from me but she was habitually abusive, I just never reported it. I did however, call the PD and try and have her removed from the residence because I was tired of her pulling stunts, being unemployed and not pulling her weight but the PD informed me since she was on the lease she had a legal right to be there. We were both intoxicated the night this happened in September 2008, the relationship had severe bumps the prior 4-5 weeks and she insulted my 2 year old daughter. I just snapped, and thank goodness my child is not hers. The child was not present, she was with her mom this night FYI) but she was an alcoholic and very unstable. Missing work or being late because she was too hung over to go frequently, hanging out until 4:00am on work nights drinking with friends, staying in motels with guys behind my back, etc.

    After that month where we mutually decided to work thinigs out she turned her tricks again and I caught her in a bar with another guy. I had enough and just walked away from that point, which was the day after Thanksgiving in 2008. I last spoke with her on January 19th, never saw her again until I was sentenced on Feb 27 and have not seen, heard or spoken with her since. No desire to whatsoever.

    I do know she moved to my city (I also moved at the end of Oct 2008 out of the residence and into a new one) and was working about a mile from my home. Since there is only one way in and one way out of my neighborhood, I had to pass her office to go anywhere and I would see her car at her work but around mid/late July I did not see it there anymore.

    I heard through the grapevine she did indeed get fired from her job (she hadn't been there a year yet) and moved to her home city with her folks.

    I know through at least the time we were together she had not filed taxes in approximately 5 years so if she did file for unemployment I believe the state would have taken any amounts from unemployment so I am assuming she is out of money. Makes sense, I just want to be prepared.

    I have contacted my attorney again this morning but still have not been able to get a hold of him.

    Should I start making consultation calls for civil attorneys? Or maybe call a clerk at the county? She had psychological problems and bad habits well before me and I feel she is trying to be opportunistic since is financially backed against a wall.
