Two years ago I was charged with Felony ID theft. The court dropped the charge to Petty theft, as even the judge said I was "way over charged." I was sentenced to 200 hours community service and restitution. I completed the CS. I paid the restitution, however, I moved out of state, and did not realize I still owed court fees. A bench warrant was issued for failing to pay fines.


Until the warrant for unpaid fines showed up, I could not pull my petty theft charge in my background check. After the warrant was issued, my background check began showing up with a Felony ID theft CONVICTION and the Petty Theft CONVICTION.


I promptly called the clerk of courts (who I already have a pre-planned payment and then surrender planed out for my fines) and they told me the conviction was for sure only the petty theft. I spent a bit of money and ordered 5 background checks off the internet, all came back with BOTH convictions.

Now a few questions:

1. I was fired from my job for lying on my application, I stated I had never been convicted of a Felony. (I came up for promotion, and a second background check was preformed, at which point they found the Felony showing up.) I was demoted, then latter fired from the company for "lying on my application."

As well, I was evicted from my apartment who preforms background checks on tenants every 6 months, now I owe the remainder of the lease.(6 months at 756 a month.)

2. Who can/should I contact about the false conviction on my background check?

3.Can I at one point sue whoever is responsible for the "error" as I was fired from my job, kicked out of my home,and now cannot find a job with a felony conviction. I don't mean sue them for millions, I would just want lost wages, and what I owe on my lease, paid for.

4. Someone tell me if I'm actually posting this in a dream. That would be amazing if I could wake up, and find this all gone.
