    Unhappy DUI in Oregon

    i just got pull over for duii and speeding at 78 on 55 zone (ors 813.010) in beaverton(washington county). the police officer pulled me over and he said that he smelled alcohol in me, and i told him that i had a big glass of cocktail where the bartender mixed up midori, rasberry with vodka and something else in there before i took that sobriety tests.
    1.first, he did the eyes test where my eyes and head are moving at the same time with the light that he was moving because he moves really far to the left then right. also, i'm a contact lenses user, so i usually get red blood shot eyes and watery eyes for not sleeping and wearing those lenses for the whole day.
    2.after, he asked me to take the walk test, where the lights aren't bright enough, therefore, i wasn't really walking street and there was a lot of little rocks on the highway. after that, he said that my performance was poorly so he took me to the washington jail and asked me to perform the breath test. and it showed up to .12. i don't know if the breath test was accurate since i'm a little girl, i'm 98 lbs, and 5'2'', i didn't eat and sleep a few days before it because i'm still in school, so most of the time, i barely sleep and i don't like to eat that much either. Also that day, like 3 hours before my arrest, i took some diet pills. so i don't know is that going to effect the breath test result.
    so is there any significant chance of me winning this case at all?
    3.I already talked to one lawyer in oregon but when i was asking him about the chance of winning he said that he isn't sure, he said i need to pay him first for the flat fee of $4000 before he could tell me more about my case. I'm wondering if you have any advice for me or any good lawyers' numbers that i can consult and give me what is my chances of winning the case.
    4. should i just agree to plead guilty and enter the diversion class since this is my first duii??
    5. if i successful pass the diversion class, will that still show duii in my record? or will they take that away and what's about my insurance, will i still able to get insurance for my car? are they going to suspended my driver license if i agree to plead guilty or no contest to the duii charge?

    Here are some tips on finding a criminal defense lawyer.

    You'll need to check the terms of the diversion program for your county, as they can very locally. Here, for example, is Boulder County's. Your county doesn't appear to provide any similar information on its website.
