    Default Can Your Ex- Get a Paternity Test if You Claim Your New Boyfriend as the Father

    My question involves paternity law for the State of: oregon

    so i used to date a alcoholic and shortly after we broke up and me and my current fiance got together, i found out that i am pregnant. so my fiance is on all of the baby's paper work so far and will be named as the father on the birth cirtificut, and i want my ex to not have anything to do with us, or our baby...

    but what i want to know is if my ex has any chance of forcing a paternity test either before or after the baby is born?

    Is he the father? If not, after all, it's no big deal - he could request a DNA test and his paternity will be disproved.

    the thing is that i don't know who is biologically the father and i don't want a dna test... i just want to know if he can some how get one ordered, even if he isn't on the birth certificate?

    doesn't he have to have some sort of way to show that he might be a possible father?

    if he doesn't then couldn't anyone off of the street go around randomly demanding paternity tests from people?

    The fact that you call him your ex is enough. Random people off the street just don't go around asking to take and PAY FOR paternity tests, and courts understand that at a fundamental level. Bottom line: if there's the possibility that he's the father, he can request the test once the baby is born, regardless of whose name is on what paperwork.

    If he's the father, you can expect that he'll have visitation rights (assuming that the court doesn't, for some reason, award custody to him) and child support responsibilities for the next 18 years. The only way the ensure that someone has nothing to do with your child is simply not to have children with them. Short of that, it's time to start thinking about how to co-parent the child, splitting up holidays, birthdays, summer vacations, and the usual challenges faced by parents who are no longer together.
