    Default What's the Easiest Way to Evict a Subtenant

    My question involves an eviction in the state of: California

    My scenario: I was forced to move out of California because I lost my job and source of income. With the my landlord's written consent, I legally sublet my apartment in Hollywood to a subtenant (because he wouldn't let me out of the lease). I was very confident in the subtenant's ability and will to pay the rent and keep the place nice. However, her first month of rent was late, and her second month's rent payment is over 2 weeks past due. I have served her with a 3-Day Notice to Pay or Quit, and I have received no response or payment.

    I am no longer concerned with getting out of the apartment without an eviction on my credit report. The whole sublease concept has been nothing but a nightmare, and I'm throwing $1000 a month away for this girl to live in the apartment without paying rent.

    I now live in Kentucky (which makes this whole eviction process quite expensive, as well as finding a new tenant when I finally get possession back).

    My question: Would it be less of a hassle to just not pay my landlord next month and get him to evict me (and her through the Process to Evict All Unknown Occupants)?

    You want an eviction on your credit report?

    Talk to your landlord about acting as your agent and prosecuting the eviction for you. The landlord may have a lawyer who works for less than one you get (eviction lawyers often give a volume discount).

    You do NOT want an eviction on your public record. It will make renting anywhere in the future just short of impossible.

    I would schedule an immediate trip back to Hollywood and let the tenant know you will be coming and that her sublease is up and that you have another tenant moving in in her place. Even if this isn't true, you need to get her out of there immediately so you CAN get someone else to sign a rental lease agreement.

    Once she has removed everything, make sure the current landlord/manager knows to take her off the lease (or any subletting paperwork). You may have to go through the process of finding another sub-letter remotely, but first things first... getting her out.
