    Default Texas C Misdemeanor Conviction Triggered by Payment of Fines

    My question involves criminal records for the state of: Texas

    My son was arrested for theft of less than $50.00 class C misdeamnor. When I went to the jail to bail him out, I was told that I could get a bail bondsman for a $400.00 bond or pay $200.00. I paid the $200.00, I called the police department a couple of days later to see if he would be going to court and was told to call the court clerk and asked about deferred ajudication. I called the court clerk and was told that the $200.00 was the fine and that it would go on his record as a class C misdeamnor and would remain there forever. My question is so by paying the fine I did not think that it was a plea of guilt only the amount to bail out. I would hate for this to remain on his record. What can I do?

    Your son can consult a lawyer about bringing a motion to set aside his conviction based upon the fact that you, not he, paid the fine and that it should not be possible for him to be convicted based upon actions you took outside of his consent or control.
