    Default getting a divorce or an annulment from an immigrant

    I got married to my husband on october 31, 2005. In the brief time that has passed I have came to the realization that he married me to become an American citizen. I don't know which way to turn but he and I are not together and i would like to resolve the relationship. We had a meeting with an attorney and she explained to me that I was to be petitioning for his citizenship (?) He has copies of all my legal documentation and refuses to return them to me. Can he do anything as far as petitioning for anything concerning his residency or citizenship without me?

    This was a lawyer he hired? It wouldn't surprise me at all if his lawyer wanted you to continue to petition for his citizenship.

    You have been married long enough that it's probably not realistic to get an annulment, even if NC law would otherwise permit annulment (and a quick review suggests that it would not). Nothing would stop you from filing for divorce.

    He can try to petition for permanent residence without you, but he would need a valid basis for immigration other than the marriage. (Presumably he's not claiming to be a victim of domestic violence.)
