    Default Age of Consent

    Ok so i know the Texas AOC is 17, and as of July 10, 2009 i turned 17.
    My boyfriend, 25, turning 26 in nov, 2009, and i started having sex around july 22nd 2009.

    Now I'm pregnant, more than 100% positive its his, and he's ran off.
    hes on probation.
    I was wondering if even though i consented, if my family pressed charges if he'd still get in trouble??

    oh and this is going by texas law

    IF there were charges to press, it would be up to the district attorney to press them. All your parents could do is report the activity to authorities - however, this is pointless because you meet the age requirement for consent.

    The best your parents can do at this point is help you to have a healthy pregnancy, help find out where he is (they can start by contacting the probation office), help you to petition in court for paternity testing once the child is born, and help you bring a child support case. Since he's on probation, if he's ordered to pay support and doesn't, he could be quickly looking at a warrant for arrest and the joys of serving jail time for his original offense (non-payment is a common probation violation).

    Essentially you're asking: I was of legal age to consent to having sex with my whatever he was to you and now that he's done something I don't like, I want to act like a small child and try to punish him in the way that my having waited until I was of age was sure to prevent.

    No, you don't get to have him arrested for rape for leaving you.

    Yeah actually i tried getting in touch with his probation officer but apparently they cant find anything on his name or with his charge,

    and obviously you cant read because i dont want to punish him, i want to get in contact with his mom to see if she wants to keep the child because i cant afford to, i said my parents are freaking out.

    Perhaps it's time to start talking to your parents and getting at least an initial consultation with an attorney regarding adoption or guardianship.

    His mom willingly taking the child might be a temporary solution, but even if his mom DID do this, the child is still legally YOURS and YOU and you alone are responsible for that child until and unless a JUDGE says otherwise. His mom could simply return the child to you at any time, for any reason, with no warning. Paternity will need to be established, or, you'll need help from an attorney to push through either an adoption or a change in guardianship (ie to his mom) if Runaway Dad cannot be located (and there's a procedure that will have to be followed to show that you've made all possible efforts to notify him of the planned adoption or guardianship - but the attorney will be well versed in this and can walk you through it).
