    Default New York "Grand Larceny 4th" Class E Felony

    My question involves criminal law for the state of: New York

    I am being charged with a Class E Felony, Grand Larceny 4th. There is extensive video evidence of me committing the crime in question and I have already signed a full confession. I was as cooperative as possible and did not request a lawyer because I did not realize the extent of the case.

    What happened, I am a resident on a college campus. I found another students ID card and used it in a vending machine to purchase about $12 worth of items on their meal plan points. Apparently these ID cards count as credit cards, making this a Class E felony. After this I disposed of the card in a nearby trashcan. I wasn't worried too much, I figured academic probation or something similar, because I had heard of dozens of instances of other students doing this, and it was a university police officer that questioned me, then they throw "Grand Larceny" in my face.

    Anyone have any idea what my punishment will likely be? Should I bother with a lawyer, or am I in too deep? I've heard that cases like this can often be dropped to a misdemeanor. What do you think the odds are of this happening? Also, I have no previous criminal record with the exception of a minor speeding ticket.

    You're charged with a felony. Of course you should consult a lawyer. You can talk to your lawyer about the chances of getting it dropped to a misdemeanor or (better) the possibility of a conditional dismissal (e.g., a deferred sentence) that would allow you to avoid a conviction.

    Yes you need a lawyer they may be able to reduce the charge to a misdemeanor or maybe you can get an acd. It would dismiss your charge if you stay out trouble for 6 months. Your probably looking at probation,fines,etc. The important thing is to avoid a felony and a criminal record if possible. If you can't afford a lawyer your entailed to a legal aid.

    Felonies are a lot more serious than misdemeanors. Careful. Have you been arrested and given a arraignment date yet? If not try to work something out like I'll pay the fines, take a self-help course, do community service for the school, write an apology letter to the other student etc etc, but please don't report this to the police. If you have been then you need to be more worried about the law than the school.

    YES, get an attorney!!! The charges will be dropped down with community service and restitution, but not because you cooperated....it only get's dropped down when the prosecutor has lunch or plays golf with your attorney and cuts a deal. If you walk in there without an attorney, you're just another notch on the prosecutors belt. I was charged 19 years ago on Grand Larceny no Auto 4th. I made some bad choices with a fake ID and some campus paychecks. The RIT head of security was gunning for me and tried to get me banned from campus, but my lawyer made a deal and it all worked out.
