    Default Charges went from three to eighty four

    My husband was arrested for "alledgedly" touching a minor. Won't go into detail, but, he did NOT do this. At the first prelininary hearing he was offered a plea bargain. If he would plea to corrupting the morals of a minor, they would drop the charges of "aggravated indecent assault" and "indecent assault". My husband refused to accept the plea, as he s innocent. Now, all of a sudden, at the 2nd preliminary hearing, they have 84 counts against him. This of course, after he again, refused to accept a plea. How did they do that? The girls and the girl's fathers' testimony were nothing. You would have laughed yourself silly throughout it. The girl didn't remember, she didn't know, maybe once, etc...... The girl is 9 yrs. old. Some of the counts are the same thing except because she's under 18, under 16, under 13 and so on. How can they do that? Don't suppose you know if my husband won't get jail for this, do you? He is innocent and will plead so.Also, should they convict him, is it possible he could go to county and get out on work release? Without him working, I have no way to continue living in our home. Thank you.

    If he is convicted of numerous sexual offenses against a minor, aged nine, he is almost certainly looking at a considerable prison sentence.

    Your husband should consult with a lawyer in your state who specializes in the defense of sexual molestation charges, and who can utilize appropriate expert witnesses in his defense. This will unfortunately not be cheap. If he cannot afford private counsel, he should certainly petition for a court appointed attorney or public defender, and the sooner the better.

    Thanks Aaron. We already have a lawyer who specializes in criminal sex crimes. He's been doing this for over 25 years (the lawyer). What are expert witnesses? This whole thing is "fishy" and it certainly appears my husband is being railroaded. As I said, this is long and complicated and I am not at liberty to really discuss any details.I still need to know how they can get 84 out of 3 charges. There are alot of articles of people who have had sex with a child and their bail was anywhere from $10,000-$25,000. My husband's was set at $100,000. These peole who have had sex with a minor get anywhere from 3-10 years is all. My husband has only "alledgedly" been accused of touching this girls butt. And he is INNOCENT! Can anyone answer my questions? Thanks!

    What is a "Monitering" hearing? Never heard of it. What do you do there? Being a wife, am I allowed to be there with my husband every step of the way? Since my husband is out on bail, should they find him guilty "for whatever", do they take him to jail right then and there? Do I even get any time with him? Can he remain out on bail till setencing? Thism is all so confusing and nervewracking, to say the least. I am just so afraid....not just for myself, but my husband, also.

    An expert witness is somebody who is qualified to provide opinion testimony. Expert witnesses for sex abuse cases can address a wide variety of issues associated with potentially false accusations.

    It depends upon the judge and local practice, but typically yes. A defendant is typically taken into custody following the verdict, and there is not ordinarily an immediate opportunity for a meeting with family members. (That might be possible later at the jail, depending upon visitation policies.)

    During the 2nd preliminary hearing, there were two women (I suppose they were there for the child in cases such as this) who sat on the defense side and during some questioning of the girl, I and another person, noticed that thses women were somwhat trying to prompt the girl by putting up fingers to thir chin (you know, like say two, and they would put two fingers up to their chin). Is that legal? Do they have a right to do that? Also, the whole time the girl was on the stand, her father was outside the door with his ear pressed up against the window part of the door. You could see him plain as day. I tapped my husband on the shoulder and directed him to look at the door. Our lawyer did not see this.Are these things our lawyer can use?
    The father works for a lawyer and is studying to become one (one year left). My husband and I befriended him and his 3 children when his wife left him suddenly (we all attended the same church). My husband would go to his house Monday nights to watch football with him (October-December). In the meantime the church Xmas play was beginning and his children were in it, so he asked my husband to pick them up from church on the way up to his house. This man would confide in my husband some very disturbing things. The man was all about getting his wife and stepdaughter back at any cost. He was not in a right frame of mind at the time. He confessed to my usband that he had the "hots" for his stepdaughter and would find ways to brush up against her, peek in on her whenever he could and would take her underwear out of the dirty clothes and masterbate on them. Said his youmgest daughter walked in on him doing this one time. Plus, there were some other sick things he told my husband. My usband kept telling im he needed to talk to someone about this as he was not qualified. My husband said he should talk to the Pastor. This is were it all began. My husband was at his house giving his son and daughter a guitar lesson, while the father sat right there on the steps watching. The boy got fidgety, so my husband had him move to the table. The daughter started to fidget, said she had a wedgie, so my husband told her to stand up and he pulled the back of her pants and shook them and then rat=tat-tat on her butt and the father suddenly jumps up and hollers at my husband to get out of his house, he saw what he did. Next thing ou know, two days later my husband gets a nasty letter from the Pastor banishing him from the church and saying he is now his mortal enemy. And the same day, we get a call from the SP. From some of the things the kids told us and with what all the father had told my usband in confidence, we feel he may very well be the pertpetrator. We beleve wholeheartedly, that the father did this (accuse my husband of something he did not do) because he was afraid my husband would tell the Pastor or some authority about his confessions. What better way than to turn the tables. This man used to be a serious drug dealer down in Fla. and said he had to flee for his life as at one point, they (drug dealers) had a gun to his head. He also stole his children from their mother (oldest one is not his) and made her out to be unfit to get custody of them. This is a man who is a wolf in sheeps clothing, if you ask me. Anyway, we believe that since the father is working for lawyer, he most certaily has connections and that is why my husband seems to be getting railroaded. We could not even get a local lawyer who would take the case and defend my husband. Why else would his bail be set at $100,000 for "alledgedly" touching this girl.
    Can everything I've said here be of use to us at the trial? How can we prove the father is doing this? The girl isn't. We have kept those 3 children overnight in our home on two occassions. The father has said my husband would rub her vagina while we watched movies in the dark at our house. We always have a light on in the living room and her brother was sitting right on the other side of my husband and I was sitting catty=cornered from them......full view. I can assure you, nothing like he says ever happened.
    I'm sorry this is so long. Our lawyer right now is in Paris for a week. I sure hope whe he gets back that he will get down to brass tacks, as it were. Things we've asked our lawyer has so far, been, "Idon't know", "Don't worry". He hasn't really told us anything that would calm our fears. I've been told by his secretary that he is good. I sure as hell hope so. This is our lives on the line here.
    When does our lawyer get EVERYTHING that the DA has on my husband? I feel time is running out and nothings' been done, yet?
    When I had to contact our lawyer to let him they went to my husband's job and arrested him, the lawyer wanted to know where they took him. I didn't know and said that I assumed the police station. Our lawyer called there and said they had no record of him being there. Our lawyer finally found out he was at the magistrate's office. By that time, they already put him in jailand had his bail set at $100,000. My husband said the very frst place they took him was to the police station where they fingerprinted him and took his picture. Can anything be done about their lying to our lawyer? Our lawyer could've been there and my husband's bail wouldn't have been set so high and perhaps he could've gotten out on his own recognicense. Our lawyer is out of our area, about 45 min. to an hour away.

    Default help for spouses

    Aaron, is there any support groups for the spouses left behind, as it were, when their husbands are sent to ail? Ordoes the system not care what they do to people's lives? Is there any support of any kind? Just wondering. Do they let the spouse know what's going on, where they will be taking him, when you can see them, etc.... Thanks.

    I am not aware of any "in person" support groups, although there really should be some. You may be able to find some online groups.

    I'm going to type in what was written in the affidavit, so could you please tell me what it stands for and what they mean?

    1. 3125 (a)(1) of the Title 18
    2 counts
    2. 3125 (a)(7) of the Title 18
    2 counts
    3. 3125 (a)(8) of the Title 18
    2 counts
    4. 3126 (a)(1) of the Title 18
    18 counts

    Am I wrong, or does that not add up to 24 counts? In the newspaper, it stated the Magistrate ruled there was sufficient evidence to hold my husband on most of the charges filed against him. Said he was ordered held for court on 55 counts of indecent assault, 22 counts of corrupting the morals of a minor and 6 counts of aggravated assault. How do they get all that out of the 24 listed? As I said before, he originally was only charged with 3 counts period. What are they doing and how are they coming up with all of this? An explaination would be appreciated. Thanks.

    What should or could I look under in order to maybe find support groups? I don't know where to begin.
