    Default Filing I-485 with an Arrest on Record 6 Months Ago

    I was arrested for receiving stolen property. A friend of mine bought merchandise online with stolen credit card and sent them to my house. I did not know he used stolen credit card. I got arrested and the case is under review. My lawyer said it is unlikely for them to file it because they cannot prove that I knowingly participated in the crime. I included a stamped letter from DA's office saying that my case is "under review but have not decided to file against me" for initial evidence. Now I am filing for I 485 and I would like to hear your opinions on my case. Thank you so much.

    There is a question there in the I485 where if you have been arrested, so I suppose your answer would be "yes" then you need to include the disposition letter from that arrest or any documents that would prove that the charges have been dropped or in your case whatever evidence is applicable (just a copy of it) or a letter from the court stating whatever is applicable and bring the originals in your future interview and if USCIS needs more evidence from you, they will send you an RFE letter. Read the I485 instructions carefully for it is stated there what documents should be included in your application if you have had an arrest.

    Thank you so much for your response. Aside from the stamped letter that I mentioned above I do not have anything else official to state the status of my case. The police did not want to issue anything. I am confident the charge will be dropped in the future because I am innocent but as of now it is "under reviewed." I wrote a letter also to explain my case. I am very worried that they will deny my application .

    You won't get denied just bec of an "under reviewed" case unless you've committed felony or something that is very serious. Just send whatever you have and if they need more from you they will say so. And by the way is your Green Card petition based on marriage? If so, then I suggest you gather all the evidence you have to prove you have a boni fide marriage bec most likely USCIS will base their decission on your marriage. Or you can also get a police clearance just in case.
