    Question Duty to Help Someone Get Medical Help

    My question involves injury or loss that occurred in the state of: Mississippi

    My question is: If an 18 year old girl gets drunk at a party and ends up having sex with a 22 year old male in a lofted bed and falls out and hits her head and fractures her arm and he leaves her without taking her to the hospital, is this neglect?

    The girl in question has no recollection of what happened. This is what the guy told his friend. She's being drug tested to see if she was slipped something or if she just can't remember because she hit her head. Thanks in advance!

    it could possibly be considered a negligent action. Were there any damages due to the alleged negligent act? If not, then she would have no damages.

    as to the testing for a date rape drug:

    some of them metabolize quickly and completely and they will not show up on a test.

    but, to a question you did not ask:

    who supplied the booze? and whose home was this?

    She had a $1,000 hospital bill (after insurance). She was at a fraternity house.

    also, I've been trying to read about the date rape drugs too. Rohypnol seems to be the most common (perhaps this is a misconception though), and i read that it metabolizes in 2-4 days, so that seems like it would show up today since it happened saturday night. There's a chance that she could have just gotten too drunk. I wasn't there but she didn't think that she had drank nearly enough to black out like that. she's never been that messed up before and her friends thought that she was acting differently than her drunk self. It's a sticky situation of course. She doesn't want to press charges, i think out of embarassment. The nurse at the health center she's at right now is trying to convince her to though.

    So, how does the guy being negligent cause her hospital bill to be any greater than if he hadn't left her after she fell out of the bed?


    as to charges being pressed; are you saying she was raped? While it has been a considerable time, she should speak with the police and the hospital to see if a rape kit would still provide any possible evidence. I suspect it would be too late for a semen sample (but honestly don't know) but a rape typically causes bruising and vaginal tearing while consensual sex generally does not result in such. Injuries such as this would be discovered and documented during a rape kit exam.
